Kaspersky Wins Kasperskyme.com Domain Name in Arbitration

An arbitrator with National Arbitration Forum has awarded the domain name Kasperskyme.com to Kaspersky Lab,the Russian computer security company. All started when Kaspersky submitted a complaint to the National Arbitration Forum asserting legal rights over the disputed domain name.
Kaspersky owns trademark registrations for the "Kaspersky" mark with the United States Patent and Trademark Office.Therefore,the disputed domain name is confusingly similar to its trademark.Moreover,Kaspersky contended that the respondent registered and used the disputed domain name in bad faith.
"Respondent fails to make an active use of the disputed domain name. The domain name resolves to a “server not found” error message. Respondent’s failure to make an active use of the contested domain name is evidence that Respondent registered and uses the disputed domain name in bad faith."
The Panel ordered the disputed domain name be transferred from the respondent to the complainant.Source from Domain News
