An arbitrator with the National Arbitration Forum has awarded two domain names to AT&T,the largest provider of fixed telephony in the United States.
The company submitted a complaint to the National Arbitration Forum, asserting legal rights over uversecentral.net and att5star.com domain names.AT&T owns trademark registrations both for the "U-Verse" mark and the "AT&T" mark. Therefore, they contended the disputed domain names are confusingly similar to its trademark.
Moreover, they contended the respondent registered and used the disputed domain names in bad faith.
"Respondent previously used the <uversecentral.net> domain name to resolve to a website that displays third-party links to competing commercial communication websites under headings such as “Uverse,” “Cell Phone,” and “At T.” "
"<uversecentral.net> and <att5star.com> domain names now resolve to websites that display various third-party links to websites and businesses unrelated to Complainant’s business. "
The Panel ordered the disputed domain names be transferred from the respondent to the complainant.Source from Dmain Name News
