An arbitrator with National Arbitration Forum has awarded two domain names,msn-reload.com, msnreplay.net to Microsoft. The company submitted a complaint to the National Arbitration Forum,asserting legal rights to the Internet domain names.
The company owns many trademark registrations with the United States Patent and Trademark Office for its "MSN" mark .Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith .
"Respondent’s <msn-reload.com> and <msnreplay.net> domain names resolve to websites that offer various third-party products, such as antivirus software, that compete with Complainant’s products. Complainant argues that these competing products disrupt Complainant’s business, which indicates bad faith registration and use."
The Panel ordered the disputed domain names to be transferred from the respondent to the complainant.Todaynic.com International Limited
