An arbitrator with the National Arbitration Forum awarded the domain name Google-iPad.com to Google .The company filed a complaint to the National Arbitration Forum on January 3,2012,asserting legal rights over the disputed domain name . Google owns many trademark registrations for the "Google" mark all over the world.Therefore,it is more than obvious that the disputed domain name is confusingly similar to its trademark.Moreover,Google contended that the respondent registered and used the disputed domain name in bad faith:
"Complainant claims the domain name was registered and is used to take commercial advantage of Internet users’ mistakes as to the source, sponsorship, or affiliation of the domain name. The disputed domain name is confusingly similar and related to Complainant’s GOOGLE mark, which ensures that some Internet users searching for Complainant will arrive at Respondent’s website instead. Once there, as the content of the disputed domain name’s resolving website is unrelated to the services which Complainant provides, the Internet users will become confused as to whether the disputed domain name is operated or affiliated with Complainant. "
The respondent failed to submit a response in this proceeding .
The Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
