Transfers falls in domain of Executive: Babar

ISLAMABAD, Jul 7 (APP): Former Federal Minister for Law, Justice and Parliamentary Affairs, Dr Babar Awan on Thursday said that the transfers and postings in the federal government departments was a prerogative of the Executive and it did not fall in jurisdiction of courts. Addressing PPP districts information secretaries here, he said that as the Executive had no right to interfere in the judicial transfers and postings similarly judiciary has no right to intervene in the transfers and postings of civil as well as in military establishment because nobody was above the Constitution and law.Babar pointed out in the last forty years no judicial verdict was delivered in favour of PPP while in the last 30 years, no decision came against the Takht-e-Lahore.
“I endorsed a statement of JUI-F chief Fazl-ur-Rehman that Mian Nawaz Sharif has highjacked the judicial system.”
The people of Pakistan would never accept judicial martial law or ultra constitutional steps, he added.
He said the state functions were based upon trichotomy of powers and no institute should overlap its limits.
He was of the view that the PPP was symbol of Federation and representative of the masses of the country. He said that some alliances and groups of opportunists are protecting their own interests.
In the past all alliances and groups had participated in the national politics without any objective, vision and manifesto, he said.
Babar Awan calling the PML-N as party of GT road said masses have restricted them to GT road.
He said people’s vote in favour of PPP in Gilgit-Baltistan and Azad Jammu Kashmir have disappointed the elements who were carrying out other agenda.
“The defeated elements during AJK elections campaign highlighted other issues and they have even did not mention the issue of right to self-determination promised by the UN in their resolution and atrocities being committed by the Indian force”.
He said Pakistan Peoples Party will complete its tenure as masses have elected PPP for five years.
“The people who are talking about mid terms election should hold local bodies election in their province first”.
He said it was the party who refused to hold by-election in Rawalpindi and AJK elections in Lahore but it is demanding mid term elections in the country.
“People who have desire for mid-terms election should wait for 2013 general election but the PPP will be victorious in the next election.”
He said no one will be allowed to commit rigging in the next general election and PPP will hold free, fair and transparent election.
The people who are claiming popularity are now hiding behind the alliances, he said adding people of the country will not allow them to achieve their nefarious designs.
Babar Awan said Pakistan People’s Party believed in taking people along on national issues.
Former Law Minister said democracy in the country will flourish and no one would be allowed to derail the democratic system.
He said it is unfortunate that courts had awarded stay order for last 12 years on the Rs. 6 billion loan taken by the Sharif brothers.
He said Punjab government has wasted Rs 44 billion in ‘Tandoor’ programme.
Former Law Minister said now punjab government is wasting Rs. 50 billion on “Afsana Housing Society”.
At the end, former Law Minister Babar Awan said that in the past Pakistan People’s Party had arranged training programmes for their workers to keep them well aware current situation of the country.
He also briefed the participants about the Bhutto case.
Former Information Secretary PPP, Taj Haider on the occasion said that PPP is ideological party and always works for this. He said whether in government or in opposition the PPP always fought for rights of the people.
Pakistan Peoples Party’s manifesto is the manifesto of poor people, he added.
Shaheed Mohtarma Benazir Bhutto promoted the politics of reconciliation as politics of confrontation was not in the interest of the country, he said.
